These Terms of Service ("Terms") constitute a legally binding agreement between you and Advanced Fluid Dynamics ("Company", "we", "us", or "our") governing your access to and use of the oqui platform, including our website, API, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
oqui is an AI-powered financial affordability assessment platform that processes financial documents (such as bank statements, payslips, and credit reports) to generate affordability assessments. The Service is available through our web-based dashboard and programmatic API.
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and API keys. You agree not to share your credentials with third parties and to notify us immediately of any unauthorized access to your account.
The Service operates on a credit-based system. Each successful affordability assessment consumes one (1) credit. Credits must be purchased in advance through our platform.
Credit prices are displayed on our pricing page and are subject to change. Any price changes will not affect credits already purchased.
All credit purchases are final and non-refundable. Credits do not expire. Failed assessments (due to document processing errors) do not consume credits.
We may provide trial credits to new accounts at our discretion. Trial credits are subject to the same terms as purchased credits but may have additional usage restrictions.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
API access is provided through API keys generated in your account dashboard. You are responsible for all activity that occurs using your API keys.
API requests are subject to rate limits as specified in our API documentation. We reserve the right to modify rate limits at any time.
We may modify the API from time to time. We will use reasonable efforts to provide notice of material changes, but you are responsible for ensuring your integration remains compatible.
You retain all rights to the documents and data you upload to the Service ("Your Data"). By uploading Your Data, you grant us a limited license to process it solely for the purpose of providing the Service.
Documents are processed using AI technology to extract financial information. While we strive for accuracy, the Service provides assessments for informational purposes and should not be the sole basis for financial decisions.
Assessment data is retained in your account until you request deletion. You may request deletion of your data at any time by contacting us. See our Privacy Policy for more details.
The Service, including all content, features, functionality, and underlying technology, is owned by Advanced Fluid Dynamics and is protected by intellectual property laws. Our AI models, algorithms, classification systems, and assessment methodologies are proprietary and confidential.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
ASSESSMENT RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR FINANCIAL, CREDIT, OR LENDING DECISIONS. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ANY INFORMATION BEFORE MAKING DECISIONS BASED ON IT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVANCED FLUID DYNAMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Advanced Fluid Dynamics and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, you may request export of your data within 30 days, after which it may be deleted.
These Terms shall be governed by and construed in accordance with the laws of Australia and South Africa, as applicable based on your location. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in those jurisdictions.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
